1. Agreement to Terms

By accessing or using Azuce.com ("the Service"), operated by Zoomash Ltd (Company No. 7838145), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service. These terms constitute a legally binding agreement between you and Zoomash Ltd.

2. Description of Service

Azuce.com provides solar production forecasting tools for solar installers and energy professionals. The Service includes web-based forecast generation, branded PDF report exports, a programmatic API, and related features. Forecasts are generated using physics-based models with satellite irradiance data and meteorological inputs.

3. Account Registration

To use the Service, you must:

  • Create an account with a valid email address and secure password
  • Provide accurate and complete registration information
  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Keep your login credentials confidential and not share them with others

You are responsible for all activity that occurs under your account. You must notify us immediately at azuce_support@zoomash.co.uk if you suspect any unauthorised use.

4. Subscription Plans and Pricing

We offer the following subscription tiers:

  • Free Plan: Up to 3 forecasts per month at no cost.
  • Professional Plan: Up to 20 forecasts per month for $49/month, billed monthly via Stripe.

All prices are in US dollars unless otherwise stated. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial months.

5. API Usage

Access to the Azuce API is subject to the following terms:

  • The first 500 API calls per month are included at no additional charge.
  • Additional API calls are billed at $0.001 per call via Stripe metered billing.
  • API keys are personal to your account and must not be shared publicly or embedded in client-side code.
  • We reserve the right to rate-limit or suspend API access in cases of abuse or excessive usage.
  • You must not use the API to build a competing service.

6. Forecast Accuracy and Disclaimer

Solar production forecasts are estimates based on historical satellite irradiance data, meteorological models, and the system parameters you provide. While we strive for accuracy, forecasts are not guarantees of actual production. Real-world performance may differ due to factors including but not limited to: local shading, equipment degradation, installation quality, weather variability, grid outages, and inverter efficiency.

You acknowledge that forecasts are provided on an "as is" basis and should be used as one input among many in solar project planning. Zoomash Ltd accepts no liability for decisions made based on forecast data.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or use automated tools to extract data beyond the provided API
  • Resell, redistribute, or sublicense the Service without written permission
  • Upload malicious content, viruses, or harmful code
  • Impersonate another person or entity

8. Intellectual Property

All content, features, functionality, software, and intellectual property of the Service are owned by Zoomash Ltd and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of the data you input into the Service (e.g., project specifications, branding assets). You grant us a limited licence to process this data solely to provide the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to the data practices described in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Zoomash Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and dispute resolution) shall continue to apply.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to registered users via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date at the top indicates when these Terms were last modified.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
